SyncGuard Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your use of the SyncGuard application ("App"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree to these Terms, you must immediately uninstall the App and discontinue its use.

2. Use of the App

SyncGuard provides secure storage and cloud-based synchronization for passwords and sensitive credentials using strong encryption. You agree to use the App solely for personal and lawful purposes. Any misuse may lead to termination of access without prior notice.

3. No Warranties

The App is provided "as-is" and "as available" without any warranties of any kind. We expressly disclaim all warranties, whether express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose.
• Warranties related to the security, reliability, or accuracy of the App.
• That your data will be backed up or restored without loss, corruption, or error.
• That the App will work on all devices or systems.

4. Limitation of Liability

Under no circumstances shall SyncGuard, its developers, affiliates, or partners be liable for any indirect, incidental, consequential, or special damages arising from your use of the App, including but not limited to data loss, account breach, or service outages—even if advised of such risks.

You acknowledge that any use of the App and storage of data is at your own risk, and you are solely responsible for managing your master password and data access.

5. User Obligations

By using SyncGuard, you agree to:

• Use a strong, secure master password and not share it with others.
• Use the App in accordance with all applicable laws and regulations.
• Not upload illegal, harmful, or unauthorized content to the App.

You are responsible for any misuse or breach that results from actions on your part, including sharing data or credentials with third parties.

6. Data Responsibility and No Complaints Clause

By using SyncGuard, you expressly agree that:

• Any issues related to data loss, breach, or access are not the responsibility of SyncGuard if encryption and security protocols were followed.
• You will not file complaints with regulators, consumer agencies, or third-party review platforms regarding the App’s data handling, provided it adheres to its published policy.
• SyncGuard is not responsible for device-level failures or improper usage of the App.

7. Indemnification

You agree to indemnify, defend, and hold harmless SyncGuard, its developers, affiliates, and partners from any claims, liabilities, losses, or damages resulting from your violation of these Terms or misuse of the App.

8. Termination

We reserve the right to terminate your access to the App at any time without notice if you violate these Terms. Upon termination, you must stop using the App and delete any associated data and backups on your device.

9. Changes to the Terms

We may update these Terms at any time. Updates will be posted within the App and will take effect immediately. Continued use of the App signifies your acceptance of any revised Terms.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of India. You agree to the exclusive jurisdiction of the courts in India for any disputes arising from or related to these Terms.

11. No Legal Action Clause

By accepting these Terms, you waive the right to pursue legal action against SyncGuard, its developers, or affiliates related to App performance, data loss, or security breaches, to the fullest extent permitted by law. If any clause is found unenforceable, the rest remain in full effect.

13. No Liability Agreement

By using the App, you agree that SyncGuard is not liable for any losses, damages, or interruptions caused by technical errors, cyberattacks, or user mistakes. SyncGuard is not responsible for the consequences of lost master passwords or inaccessible data.

No refunds, compensation, or reimbursements will be provided for such issues.

14. Final Agreement

This document represents the entire agreement between you and SyncGuard regarding use of the App. By continuing to use SyncGuard, you agree to all of the above terms and conditions.
